Research KeywordsFundamental elucidation of Intellectual Property Rights Law System / Law in the context of Social Capital / Identifying the function of Media in Cultural Diversity
Self IntroductionMy research mainly focuses on the nature of intellectual property rights as an “incentive to the media.” As a practioner for more than twenty years, I have specialized in intellectual property rights and finance areas. Through those years, I have developed some doubts as to the effectiveness of the market model often used in intellectual property rights related discussions. My doubts have grown greater, especially against the use of such a model in a context of Law & Economics analysis of copyright law, with and after the publication of “An Economic Analysis of Copy Right Law (18 The Journal of Legal Studies 325 (1989) ) by Williams M. Landes and Richard A. Posner.

I came to think that utilizing a concept of Social Capital would lead us to a construction of a new social model for scrutinizing the fundamental role of the intellectual property law system. I have been trying to understand intellectual property not as an “incentive to create” but as an “incentive to media activities that provide access to creation.” By using this concept, I aim at preparing an arena where constructive discussions occur, possibly clarifying rather convoluted and confusing recent discussions over the interpretation as well as legislation of intellectual property laws..
